Collection Notice

This Collection Notice sets out the matters described in Australian Privacy Principle (APP) 5.2 (as part of the Privacy Act 1988 (Cth)) as they relate to P & G Genis Steel Construction Pty Ltd ACN 103 250 004 (which, for the purpose of this Collection Notice includes any of its Related Bodies Corporate, as that term is defined in the Corporations Act 2001 (Cth)) (Genis Steel, we, us, our) when we collect personal information about you.

 

1 Purpose of Collection

We collect your personal information primarily to:

• provide you with the goods, services and information that you request from us;

• provide you with information about Genis Steel’s products and services;

• suggest Genis Steel products and services to you; and

• otherwise manage our relationship with you.

 

If you are a contractor, or another third party supplier of products or services to Genis Steel (Supplier), we will collect your personal information primarily to contact you for business purposes and manage our relationship with you or your organisation.

 

If it is reasonable to expect that we would use or disclose your personal information for purposes which are related to the above primary purposes, we may also use or disclose your personal information to:

• assist you with enquiries or complaints;

• develop and improve our client service and relationships;

• promote, advertise and market any of our products and services, including to invite you to events or activities hosted by Genis Steel;

• to comply with our legal obligations (including to comply with any law or any lawful request of a law enforcement agency or government authority), resolve any disputes that we may have with any of our clients and enforce our agreements with third parties such as your employer;

• for internal marketing reporting purposes;

• inform you of developments at Genis Steel and other services that we can provide.

 

Direct Marketing

We may use your name, email address and telephone number for direct marketing purposes. Where possible, we will provide you with a choice to opt-out of any of our marketing communications. We will respect your request to decline to receive these marketing communications.

 

2 Type of personal information collected and consequences if personal information is not collected

• address, email address, telephone number and other contact details; and

• details about you to assist in managing our relationship with you.

 

If you are a Supplier we may also collect details about the business that you represent and the insurances that you hold.

 

If you are a Candidate, we may also collect details about your employment history and other details about you to assist with the recruitment process. We may collect this information from you directly, or from a recruiter.

 

In addition to the information set out above, when you make an enquiry about our products and/or services (including on our website www.genissteel.com.au (Website)), provide us with feedback, asked to be placed on one of our mailing lists, or supply goods or services to Genis Steel, we may also collect and hold details of the products or services we have provided to you or that you have enquired about, including any additional information necessary to deliver those products and services and respond to your enquiries.

Genis Steel may collect personal information about you when you:

• apply as a candidate for a position of employment with Genis Steel (Candidate);

If you are a contractor, or another third party supplier of products or services to Genis Steel (Supplier), we may also collect personal information about you from your employer or the contractor to whom you provide goods or services.

 

If you are a customer or potential customer, we may collect your personal information from other steel companies.

 

4 Sharing of your personal information

We may disclose your personal information to:

• external providers of services that we may use to operate our business and manage our business systems (for example, this may include marketing service providers; couriers and/or freight and transport service providers, factory subcontractors, providers of payment processing services and IT technicians who may need access when providing on-site support (although it is our practice for them to work under supervision)); and

• our professional advisors and agents.
If you are a Supplier, we may disclose your personal information to your employer, colleagues or the contractor to whom you provide services. For example, for personnel of a rigging company, we may share your personal information with builders/contractors at the sites at which you will provide the services.

 

We may disclose your personal information to these third parties so that they can assist us with providing the best possible service to you or your employer.

Those third parties will be permitted to access only the personal information they need to deliver the service to Genis Steel or to you. We may disclose your personal information to contractors based in the Philippines. We are otherwise not likely to disclose information to overseas recipients unless it is with your consent, or the disclosure is required or authorised by law.

Credit Provider Collection Notice for Credit Information

P & G Genis Steel Construction Pty Ltd (which, for the purpose of this Credit Provider Collection Notice includes any of its Related Bodies Corporate, as that term is defined in the Corporations Act 2001 (Cth)) (Genis Steel, we, us, our) treats your credit information in accordance with Genis Steel’s Credit Reporting Policy. This policy explains:

• how we manage your credit information and credit eligibility information,

• how you may:

o access your credit eligibility information held by us;

o seek correction of your credit information or credit eligibility information held by us;

o complain about a failure by us to comply with the credit reporting provision of the Privacy Act 1988 (Cth) (Privacy Act) or the Credit Reporting Code and how we will deal with such complaints; and

o whether it is likely that Genis Steel will disclose your credit information or credit eligibility information to entities that do not have an Australian link and, if so, the countries in which those entities are likely to be located.

Disclosure to Credit Reporting Bodies

 

If Genis Steel considers it necessary in assessing your or your company’s credit application, and to regularly review your ongoing worthiness for commercial credit, Genis Steel may obtain from, or disclose to a credit reporting body (as defined in the Privacy Act) (including CreditorWatch) as defined in the Privacy Act, credit reports or information containing both commercial and consumer credit information about you. If you fail to meet your payment obligations in relation to consumer credit or commit a serious credit infringement, Genis Steel may be entitled to disclose this to CreditorWatch. You can obtain a copy of CreditorWatch’s policy about the management of your credit related personal information on its website.

You have the right to:

• request CreditorWatch not to use your credit reporting information for the purposes of pre-screening of direct marketing by a credit provider; and

• request CreditorWatch not to use or disclose credit reporting information about you, if you believe on reasonable grounds that you have been or likely to be a victim of fraud.

Credit Provider Credit Reporting Policy

This Credit Reporting Policy sets out how P & G Genis Steel Construction Pty Ltd ACN 103 250 004 (which, for the purpose of this Credit Reporting Policy includes any of its Related Bodies Corporate, as that term is defined in the Corporations Act 2001 (Cth)) (Genis Steel, we, us, our) manages credit information about individuals, in accordance with the Privacy Act 1988 (Cth) (Privacy Act) and the Credit Reporting Code (CR Code). Genis Steel is
a Credit Provider for the purposes of the Privacy Act.

 

By engaging Genis Steel to provide you or your organisation with products or services you are taken to have read, and agreed to the collection, use, disclosure and handling of your credit information in accordance with
this Credit Reporting Policy.

 

Collecting Credit Information

 

Genis Steel collects credit information for the purpose of providing you with credit, verifying your details, managing the credit Genis Steel provides you or our Genis Steel with, and for debt collection purposes.

 

Credit Information has the meaning given to that term in the Privacy Act and includes, amongst other things, identification information, consumer credit liability information, repayment history information and default information about an individual.

 

Credit Eligibility Information has the meaning given to that term in the Privacy Act and includes, amongst other things, credit reporting information about an individual that has been disclosed to a credit provider by a credit reporting body.

 

CP Derived Information has the meaning given to that term in the Privacy Act and includes any personal information about an individual that is derived from credit reporting information that was disclosed to a Credit Provider by a Credit Reporting Body that has any bearing on an individual’s credit worthiness and that is used (or could be used) to establish the individual’s eligibility for consumer credit.

 

When this policy refers to credit information, it is a reference generally to the three kinds of credit information set out above, unless stated otherwise.
Genis Steel may collect credit information from various sources, including you, your application for credit, other credit providers (including trade references) and credit reporting bodies (including CreditorWatch).

 

Genis Steel may collect and hold the following kinds of Credit Information and Credit Eligibility Information about you:

• identification information such as your full name, date of birth, address, telephone number, name of
employer, job title and drivers licence details;

• repayment history information;

• loan repayments or debit balances which are overdue and for which debt collection has started;

• information about credit infringements (including serious credit infringements, fraudulent credit behaviour
or an intention shown not to comply with your credit obligations);

• information about dishonoured cheques;

• court proceeding information; and

• default information.

 

Genis Steel may also request information from a Credit Reporting Body (such as CreditorWatch) when you apply for credit from us. Genis will only request this information where it is permitted under the Privacy Act.

Generally, this is when the purpose of collection is to assess your or your organisation’s application for credit or to collect payments that are overdue.
Genis Steel may derive CP Derived Information from information disclosed to us by Credit Reporting Bodies, including credit history information, credit rating and default information.
Use of Information
Genis Steel may collect, hold and use your Credit Information and Credit Eligibility Information to assess consumer credit applications, collect payments that are overdue in relation to consumer credit or to manage consumer credit.
Genis Steel may otherwise use your information to comply with any lawful request of a law enforcement agency or government authority.
Genis Steel will only use Credit Eligibility Information where it is permitted by the Privacy Act.
Disclosure to Third Parties, including Credit Reporting Bodies
If Genis considers it necessary in assessing your credit application, and to regularly review your ongoing worthiness for commercial credit, Genis Steel may obtain credit reports or information containing both commercial and consumer credit information about you from a credit reporting body (including CreditorWatch).
Where the information disclosed is default information in relation to consumer credit, Genis Steel will not disclose it to the Credit Reporting Body unless at least 14 days have passed after Genis Steel have given written notice to you of our intention to disclose such information to the Credit Reporting Body.
Genis Steel may also disclose your Credit Information or Credit Eligibility Information to the following third parties:
• other Credit Providers;
• our lawyers or a debt collection agencies for the purposes of collecting an overdue payment for consumer credit;
• law enforcement bodies if required or permitted by law; and
• another person for an external dispute resolution purpose.

 

However, Genis Steel will only disclose Credit Eligibility Information where it is permitted by the Privacy Act.

 

Genis Steel disclose this information so that third parties can assist us with functions that Genis Steel outsource to them, assessing applications for credit, certifying your details, managing your credit application or for debt collection purposes.

 

We may disclose your personal information to contractors based in the Philippines. We are not otherwise likely to disclose information to overseas recipients unless it is with your consent, or the disclosure is required or authorised by law.

 

Genis Steel will not otherwise disclose credit information about you unless the disclosure:

• is required or authorised by law; or

• you have consented to our disclosing the information about you.

 

Information Quality

 

Genis Steel aims to ensure that your credit information is accurate, complete and up to date. To assist us in this, you need to provide true, accurate, current and complete information about yourself as requested and properly update the information to us to keep it true, accurate, current and complete.

If you believe that the credit information Genis Steel holds is inaccurate or incomplete, please contact the Privacy Officer and Genis Steel will use all reasonable efforts to correct the information.

If Genis Steel does not believe the credit information to be incorrect, it will take reasonable steps to add a statement to the information claiming that you believe the information is inaccurate, incomplete, out of date.

 

Accessing and Correcting Your Information

 

Subject to exceptions allowed by law, you can access your own personal credit information by contacting Genis Steel’s Privacy Officer. If the information held by Genis Steel is inaccurate, incomplete or not up to date you may request Genis Steel to correct the information. You may be required to put your request in writing for security reasons.

 

Genis Steel will give you access to, or correct, your personal information unless there is a lawful reason for refusing your request for access or correction. If Genis Steel refuses your request it will give you a written notice explaining our reasons for that refusal and how you may complain about that refusal.
Securing your Information

 

Genis Steel will take reasonable precautions to protect your credit information from misuse, interference and loss, as well as from unauthorised access, modification or disclosure. Genis Steel uses a number of physical, administrative, personnel and technical measures to protect your credit information.

 

Genis Steel takes reasonable steps to destroy or permanently de-identify your credit information if it is no longer needed.

 

Changes to this Credit Reporting Policy

 

Genis Steel reserves the right to make amendments to this Credit Reporting Policy at any time for any reason. Genis Steel will publish any updated Credit Reporting Policy on our website www.genissteel.com.au
Complaints

If you have a complaint about Genis Steel’s collection, use or disclosure of your credit information, or you wish to make a complaint about a breach of the APPs, please contact the Privacy Officer at the details set out below.
In your complaint, please set out the details of your complaint and your contact details. Genis’ Privacy Officer will contact you to acknowledge your request and ask for any other applicable information. Genis Steel’s Privacy Officer will then investigate the issue and advise you in writing of the outcome.

Genis Steel acknowledges its responsibilities to ensure that the Occupational Health and Safety Act Victoria and accompanying Regulations and Compliance Codes are attained to the highest standards and that risks are controlled. To support our commitment to all aspects of the Occupational Health and Safety Act (OH&S), we have implemented a comprehensive system that meets the requirements of AS/NZS 4801, and we comply with the National Code of Practice for construction work.

The Environmental Sustainability Charter Group is made up of steel industry companies who have committed themselves to the Environmental Sustainability Charter (ESC). There is a credit point available for builders who utilise fabricators who are members of the ASI’s ESC Group.

 

We hope to contribute to the foundation of an environmentally sustainable future for our community and future generations. Our policy is communicated and agreed to by all staff and subcontractors so that all persons working for or on behalf of Genis Steel are committed to environmental protection throughout their daily tasks.
